
Belgium has officially joined the case initiated by South Africa at the International Court of Justice (ICJ), alleging that Israel is committing acts of genocide in Gaza. This significant development, announced by the ICJ—The Hague’s principal judicial body under the United Nations—marks Belgium’s declaration of intervention in the proceedings. The ICJ has received backing from various countries, including Brazil, Colombia, Ireland, Mexico, Spain, and Turkiye, who have also expressed their support for the case.
The allegations stem from South Africa’s claim, articulated in December 2023, that Israel’s military actions in Gaza are in violation of the 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide. In response to the gravity of the situation, the ICJ issued provisional measures in January 2024, mandating Israel to engage in actions to avert genocide and to facilitate unhindered access for humanitarian aid to the affected areas. While these orders are legally binding, the ICJ lacks a mechanism for direct enforcement.
In a broader context, the ICJ has also deemed Israel’s presence in occupied Palestinian territories as unlawful and condemned policies resembling annexation. Despite the court’s findings and the upsurge of international criticism, Israel has continued its military operations in Gaza and the West Bank, advancing plans that many see as attempts to further annex Palestinian land.
The situation is further complicated by the ongoing military and financial support that Israel receives from the United States and several European allies. The U.S. government has dismissed South Africa’s legal arguments, prompting criticism from various lawmakers and even repercussions targeting members of the International Criminal Court (ICC), which has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant.
Notably, Belgium’s recognition of the State of Palestine in September aligns it with a growing international consensus, as nearly 80 percent of UN member states now formally recognize Palestine. The humanitarian crisis continues to escalate, with recent reports from the Palestinian Ministry of Health in Gaza indicating that the ongoing conflict has resulted in the tragic deaths of nearly 71,000 Palestinians and left more than 171,000 wounded since the war’s inception on October 7, 2023.
As the legal proceedings unfold at the ICJ, the global community watches closely, hopeful for accountability and peace in a region longing for resolution.
